The Ultimate Question: the Constitution or Trump??

Finally, the question has arrived that I had feared: “President Donald Trump is asking the Supreme Court to eliminate a key tool that lower courts have used to block various aspects of his agenda.” (Politico).

I do hope that the U.S. Supreme Court (a.k.a. SCOTUS) will respect the U.S. Constitution. Nevertheless, I doubt that all SCOTUS members will respect their oath of office. Some seem to prefer ideology.

I suppose the members of the U.S. Supreme Court must realise that granting Trump’s requests (eg, birthright, blocking court orders) will imply that the future role of SCOTUS is doubtful – or even nonexistent.

Following acceptance by the U.S. Supreme Court of Trump’s requests, King Donald (eg, the Hill, Washington Post) will – eventually – abolish the trias politica, which term is also known as the separation of powers:

“The separation of powers principle functionally differentiates several types of state power (usually law-makingadjudication, and execution) and requires these operations of government to be conceptually and institutionally distinguishable and articulated, thereby maintaining the integrity of each.”

Hence, courts grapple with ‘King’ Trump, like this judge:

“A President who touts an image of himself as a ‘king’ or a ‘dictator,’ perhaps as his vision of effective leadership, fundamentally misapprehends the role under Article II of the U.S. Constitution”.

Sometimes, I feel the same as Rob de Wijk, expert international relations: It’s a total illusion that things will improve in America; or in Dutch FT: ‘Tegen mensen die hopen dat het nog goed komt zeg ik: dat is een totale illusie.’
